CONCERNING
PROCEDURES FOR THE IMPORTATION INTO AND EXPORTATION FROM THE TERRITORY OF THE REPUBLIC OF INDONESIA OF PLANT PROPAGATING MATERIAL OF FOREST PLANT

THE MINISTER OF FORESTRY,

Considering :

• a. that Decree of the Minister of Forestry No. 57/Kpts-II/1990 has laydown provisions regarding plant propagating material of forest plant;
• b. that to implement the provision of Article 6 in Decree of the Minister of Forestry No. 57/Kpts-II/1990 it is deemed necessary to lay down a Decree of the Minister of Forestry concerning Procedures for the Importation into and Exportation from the Territory of the Republic of Indonesia of Plant Propagating Material of Forest Plant.

In view of:

• 1. Law No. 5/1967 (Government Gazette 1967 No. 8);
• 2. Decree of the President of the Republic of Indonesia No. 15/1984 connected with Decree of the President of the Republic of Indonesia No. 25/1990;
• 3. Decree of the President of the Republic of Indonesia No. 64/M/1988;
• 4. Decree of the Minister of Forestry No. 116/Kpts-II/1989 connected with Decree of the Minister of Forestry No. 368/Kpts-II/1990;
• 5. Decree of the Minister of Forestry No. 57/Kpts-II/1990.

DECIDED :

To stipulate :

DECREE OF THE MINISTER OF FORESTRY CONCERNING PROCEDURES FOR THE IMPORTATION INTO AND EXPORT-ATION FROM THE TERRITORY OF THE REPUBLIC OF INDONESIA OF PLANT PROPAGATING MATERIAL OF FOREST PLANT.

Article 1

(1) The granting of permit for the exportation from the territory of the Republic of Indonesia of plant propagating material of forest plant rests with the Minister of Forestry.

(2) The granting of permit for the importation into the territory of the Republic of Indonesia of plant propagating material of forest plant rests with the:

• a. Director General of the Agency for Forestry Research and Development if the plant propagating material of forest plant is to be used for research purposes, testing and laying out nursery-garden or if it has never before been imported into the territory of the Republic of Indonesia.
• b. Director General of Reforestation and Soil Rehabilitation if the plant propagating material of forest plant is to be used for reforestation and industrial plant forest.

Article 2

(1) Application for permit to export plant propagating material of forest plant from the territory of the Republic of Indonesia shall be submitted to the Minister of Forestry, copies of which shall be sent to the :

• a. Director General of Reforestation and Soil Rehabilitation;
• b. Director General of Forestry Research and Development.

(2) The Minister of Forestry shall grant the permit for the exportation from the territory of the Republic of Indonesia of plant propagating material of forest plant on the suggestion of the Director General of Reforestation and Soil Rehabilitation and Director General of Forestry Research and Development.

Article 3

Any exportation from or importation into the territory of the Republic of Indonesia of plant propagating material of forest plant shall be subjected to plant quarantine regulations.

Article 4

The Directions for the administration of this Decree shall be set forth by the Director General of Reforestation and Soil Rehabilitation and Director General of Forestry Research and Development according to their respective fields of duty.

Article 5

This Decree shall take effect on the date of issuance.
